A competition is in no way connected to Facebook and Instagram, it is not organised or supported by them. Information about Competition Participants is not provided to Facebook and Instagram, but to Katkyn, s.r.o., as the website administrator of Tedaria.com on social networks of Facebook and Instagram. Information acquired from Competition Participants shall be used exclusively for the purposes of the given competition. Facebook or Instagram are not liable for the content of a competition, it is exclusively the liability of their organiser.
1. Competition organiser
The competition organiser on social networks (“Competition”) is Katkyn, s.r.o., with company seat at Areál Istrochem, Vajnorská 127/C, 831 04 Bratislava, Slovak Republic, Registration number: 54 684 790, registered in the business register of the Bratislava I District Court, Section: Sro, Insert number: 77431/B (“Organiser”).
2. Period of a Competition
The Competition takes places within the time specified in the post published on Facebook at https://www.facebook.com/Tedaria.com and/or Instagram at https://www.instagram.com/tedaria.com.
3. Eligibility conditions within the Competition
Only a natural person over the age of 18 (persons under the 18 can participate only with the consent of their legal representative) with the delivery address within the territory of the Slovak Republic (“Competitor” or “Competition Participant”) is eligible to be a participant of the Competition).
Eligibility conditions of the Competition are specified within the Organiser’s post on the Tedaria.com Facebook account and/or on the Tedaria.com Instagram account. Competitors can participate in the Competition repeatedly during the duration of the Competition, however, a Competitor can become a Winner only once;
Employees of Tedaria.com are excluded from the Competition. Family members (spouse, children, parents, siblings) of Tedaria.com employees are not excluded from the Competition.
4. Evaluation of the Competition and prizes
The assessment of the fulfilment of all eligibility conditions of the Competition are exclusively within the competence of the Organiser for each Competitor.
A Competitor determined by the Organiser who has fulfilled all eligibility conditions of the Competition shall become the Winner of the Competition.
The selection of a Winner shall take place without the presence of the public. The number of winners is exactly determined in the post on the Tedaria.com Facebook account and/or on the Tedaria.com Instagram account.
The Competition concerns the product displayed within the post.
The winners shall be announced in a post on the Tedaria.com Facebook account and/or on the Tedaria.com Instagram account no later than 5 working days following the draw.
Winners will be asked to send contact details via a message to the Tedaria.com Facebook account and/or to the Tedaria.com Instagram account.
Prizes shall be sent to the Winners via a mail carrier or courier with delivery to the address specified by the Winner and communicated to the Organiser. The Winner is liable for the accuracy and up to date character of data necessary for the delivery of the Prize. The Organiser is not liable for theft, loss, damage to the Prize, its failure to delivery or delay of delivery which are caused by the mail carrier or courier.
5. Exclusion of a Competitor
The Organiser reserves the right no to include a Competitor whose comment will contain a rude offensive expression or whose comment will go against decency in the Competition.
6. Participation in a Competition and consent to the processing of personal data
6.1 The Organiser is the Controller and person liable for the processing of Participants’ personal data within the Competition.
6.2 The participant of the Competition grants their consent to the Conditions of the Competition by their involvement in the Competition and at the same time grants their explicit consent to the Organiser with the processing of their Personal data. The purpose of this processing is to ensure the organisation and assessment of the Competition in accordance with the Conditions (e.g. the handing over of the Prize to the Winner of the Competition, publishing of the first and last name and city of the Competition Winner within communication media, at the Organiser's website and Facebook page above).
6.3 Competition winners’ Personal data shall be stored following the end of the Competition in the extent necessary for the purposes of Organiser’s legal protection (e.g. enforcement of legal rights, defence in case of redress by the Organiser etc.). According to this point of the Conditions, participation in a Competition is not possible without granting consent.
6.4 Participant’s consent to the processing of their personal data under point 6.2. and 6.3. of the Conditions is voluntary and does not represent a requirement related to the provision of other services of the Organiser (e.g. sale of goods).
6.5 Any of the granted consents under point 6.2. and 6.3. of the Conditions can be withdrawn in writing at any time by a written notice addressed to the address of the Competition Organiser’s company seat or to the e-mail address of the Organiser’s responsible person: support@tedaria.de. If the Participant withdraws their consent under point 6.2. of the Conditions granted for the purposes of organising a Competition, their participation in the Competition is no longer possible. The withdrawal of consent does not influence the lawfulness of data processing which arose from the consent prior to its withdrawal.
6.6 The Participant agrees that following the expiration of their consent to the processing of personal data as well as expiration of the purpose for which the data were processed, these were immediately eliminated without the necessity of further notification from the Organiser due to economic reasons, if an obligation of their further storage does not arise from specific legislation.
6.7 Personal data processed within the Competition can be provided only to the operator of Facebook and Instagram for the purposes of their publishing, in a strictly necessary extent: first and last name and the city of the Competition Winner.
6.8 Upon a request of the Participant as the data subject and provided that they comply with the requirements established by the Regulation, the Organiser informs this person whether they are processing their personal data and if so which of their personal data are being processed. Provided that the data subject complies with the requirements established by the Regulation they have the (i) right to access their personal data, (ii) right to rectification of personal data, (iii) right to restriction of processing of personal data, (iv) right to object processing of personal data processed for the purposes of direct marketing, (v) right to erasure of personal data, particularly if they are no longer needed for the purposes for which they were acquired or otherwise processed or if the data subject withdrew their consent to their processing and if there is no other legal basis for processing or if personal data were processed illegally and the (iv) right to data portability. For these purposes the data subject can contact the Organiser at any time at the company seat address of Katkyn, s.r.o. or e-mail address of the Organiser’s responsible person: support@tedaria.de or via the telephone number: +421 944 627 725. The Organiser shall process the data subject’s request without undue delay and in any event within the time limits established by generally binding legislation.
6.9 Data subjects have the right to submit a complaint to the Office of Personal Data Protection of the Slovak Republic with company seat at Hraničná 12, 820 07 Bratislava 27, Slovak Republic, Registration number: 36064220, telephone: +421/2/3231 3220 or +421 2 323 132 14, e-mail: statny.dozor@pdp.gov.sk particularly in case of suspected personal data breach.
Final provisions
By participating in this Competition the Competitor grants the Organiser their consent to the wording of these Rules.
The Competitor is not entitled to claim the provision of the Prize and the Competitor is not entitled to request an alternative performance instead of the Prize from the Organiser. At the same time the Competitor is not obliged to accept the Prize.
The Organiser reserves the right to replace the Prize with a different prize of comparable type and value and change the conditions of the handing over of the Prize.
The Organiser is no liable for any damages incurred by the Competitor due to the participation in the Competition or unavailability/malfunctioning of devices or networks necessary for the course of the Competition and the participation in it.
